1. Acceptance of Terms:

Welcome to the Cap Zone website (capzonela.com). By accessing and using this website, you agree to be bound by these Terms and Conditions of Use (the “Terms”) and all applicable laws and regulations. If you do not agree with any part of these Terms, you are prohibited from using or accessing this website. These Terms constitute a legally binding agreement between you and Cap Zone, located at 1030 S Los Angeles St, Fl 2 & 3, Los Angeles, CA 90015.   

2. Use License:

Permission is granted to temporarily download one copy of the materials (information or software) on the Cap 1 Zone website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:   

  • Modify or copy the materials;
  • Use the materials for any commercial purpose, or for any public display (commercial or non-commercial);  
  • Attempt to decompile or reverse engineer any software contained on the Cap Zone website;  
  • Remove any copyright or other proprietary notations from the materials; or
  • Transfer the materials to another person or “mirror” the materials on any other server.  

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Cap Zone at any time. Upon terminating your viewing of these materials or upon termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.  

3. Account and Access:  

  • Account Creation: While browsing may not require an account, placing orders or accessing certain features may require you to create an account. You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activity that occurs under your account.  
  • Accurate Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.  
  • Account Security: You are responsible for any unauthorized access to or use of your account. You agree to notify Cap Zone immediately of any unauthorized use of your account or any other breach of security.  
  • Termination of Access: Cap Zone reserves the right to suspend or terminate your access to the website, without notice, for any reason, including but not limited to a violation of these Terms. As stated in our policy, repeated failures to update payment information may result in your account being blocked. Access will be reinstated after three successful transactions are completed directly through our website.  

4. Ordering and Payment:

  • Product Information: We strive to provide accurate product descriptions and pricing. However, errors may occur. Cap Zone does not warrant that product descriptions or other content on the website are accurate, complete, reliable, current, or error-free.
  • Pricing: All prices are listed in USD and are subject to change without notice. Sales tax will be applied to orders shipped to California addresses.  
  • Handling Fee: All purchases incur a 6% handling fee with a cap of $15 USD.
  • Shipping Estimates: Shipping amounts shown at checkout are often estimates. For accurate shipping costs, please inquire via messages or phone at (213) 742-6664.
  • Processing Time: During non-holiday seasons, the average ship-out time is 2-3 business days. During peak holiday seasons (beginning November), our fulfillment center requires 4-7 business days to process an order starting from the day after your order is placed.
  • Shipping Labels: We do not bill to buyer’s UPS accounts. However, you may email us your own label (weight & dimensions will be provided).
  • Payment: You agree to pay the total amount for your order, including the price of the products, applicable taxes, and shipping and handling fees. We accept various forms of payment as indicated on the website.
  • Preauthorization: Upon checkout, a preauthorization will be initiated with an estimated shipping fee, which may be an over-estimate of the actual shipping fee. The final adjusted amount, reflecting the actual shipping fee, will be captured once your order has been processed and shipped.
  • Minimum Quantity for Samples: Unless you meet the minimum quantity set by the product, you cannot purchase samples.

5. California Proposition 65 Warning:

As a California-based business, please be advised that all products are subject to California Proposition 65. This regulation applies exclusively within the state of California. For further information, please visit www.P65Warnings.ca.gov.

6. Buyer Images Download Policy:

Please be aware that variations in color tone and shade may occur between website images and actual items due to lighting, monitor brightness, contrast, and other display settings.

7. Intellectual Property:

The content, trademarks, logos, service marks, trade names, and other intellectual property displayed on the Cap Zone website are the property of Cap Zone or its licensors and are protected by copyright, trademark, and other intellectual property laws. You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website, except as generally and ordinarily permitted through the website according to these Terms.  

8. Disclaimer:

The materials on the Cap Zone website are provided on an “as is” and “as available” basis. Cap Zone makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Cap Zone does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.  

9. Limitations of Liability:

In no event shall Cap Zone or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Cap Zone website, even if Cap Zone or a Cap Zone authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.  

10. Accuracy of Materials:

The materials appearing on the Cap Zone website could include technical, typographical, or photographic errors. Cap Zone does not warrant that any of the materials on its website are accurate, complete, or current. Cap Zone may make changes to the materials contained on its website at any time without notice. Cap Zone does not, however, make any commitment to update the materials.

Cap Zone has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Cap Zone of the site. Use of any such linked website is at the user’s own risk.

Cap Zone may revise these Terms at any time without notice. By continuing to use this website after any revisions become effective, you agree to be bound by the revised Terms.   

13. Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in California for the resolution of any disputes arising out of or relating to these Terms or your use of the Cap Zone website.  

14. Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.  

15. Entire Agreement:

These Terms constitute the entire agreement between you and Cap Zone regarding your use of the website and supersede all prior and contemporaneous communications and proposals, whether oral or written.
